1. About these terms
These booking conditions apply to all Umrah, Hajj, flight, hotel and related travel arrangements booked with Babul Haram Travels, 9 Station Road, Yiewsley, West Drayton, UB7 7BT, UK (“we”, “us”, “our”). Please read them carefully before you book. By making a booking, the person making it (the “lead traveller”) confirms that they are at least 18 years old, that they accept these conditions on behalf of everyone in the party and are authorised to do so, and that all details provided are accurate and complete.
2. Making a booking
When you enquire we will send you a quotation. A booking is confirmed only when we have received the required deposit (or full payment where stated) and have issued a written booking confirmation or invoice. Please check the confirmation as soon as you receive it and tell us about any errors within 48 hours; changes requested later may incur charges. Prices are quoted per person, on the room-sharing basis stated, and are subject to availability until your booking is confirmed.
3. Prices and payment
The deposit required and the date by which the balance must be paid are shown on your quotation and confirmation. If the balance is not received by the due date we may treat your booking as cancelled by you and apply the cancellation charges in section 5. Some airline fares, hotel rates and visa fees must be paid in full at the time of booking and are non-refundable; we will tell you when this applies.
After your booking is confirmed we will only increase the price to reflect changes in the cost of fuel, in taxes or fees imposed by third parties (such as airport, visa or tourism charges), or in exchange rates, and never within 20 days of departure. If any increase exceeds 8% of the package price you may cancel and receive a full refund of the amounts you have paid to us.
4. Changes by you
Requests to change a confirmed booking must be made in writing by the lead traveller. We will try to help, but changes are subject to the terms of our suppliers and may incur an amendment fee together with any costs charged by the supplier. Name changes and date changes on airline tickets are frequently not permitted and may require a new ticket to be purchased.
5. Cancellation by you
Cancellations must be made in writing by the lead traveller and take effect on the day we receive them. Cancellation charges are set out on your quotation and confirmation and reflect the costs we have already committed to suppliers on your behalf. Visa fees, non-refundable air tickets and hotel deposits are normally lost in full. We strongly recommend that you take out travel insurance that covers cancellation as soon as your booking is confirmed.
6. Changes or cancellation by us
Occasionally we have to make changes to confirmed arrangements. Minor changes (for example a change of airline, a flight time change of less than 12 hours, or a change to a hotel of the same or higher standard in a similar location) will be notified to you as soon as possible. If we have to make a significant change or cancel your booking, you may accept the change, take an alternative arrangement of equivalent or higher standard if we are able to offer one, or cancel and receive a full refund of all money paid to us within 14 days.
We will not pay compensation where a change or cancellation results from unavoidable and extraordinary circumstances beyond our control, including changes to Saudi visa, quota or permit rules, decisions of the Saudi Ministry of Hajj and Umrah, epidemics, war or civil unrest, natural disasters, industrial action, or the closure of airspace or airports.
7. Passports, visas and health
Every traveller must hold a passport valid for at least six months beyond the date of return. Umrah and Hajj visa requirements are set by the Saudi authorities and may change at short notice. We will assist with the visa application, but issuing a visa is entirely at the discretion of the authorities and we cannot be held responsible for a refusal or delay. Vaccinations and other health requirements (for example the meningitis ACWY vaccine) are the responsibility of each traveller. Hajj places are subject to the official permit and quota process and to the dates announced by the Saudi Ministry of Hajj and Umrah.
8. Flights
Flight times shown are provisional and may change. You must check in within the times specified by the airline and comply with its baggage allowance and conditions of carriage. We act as an agent for the airline in respect of flights; your rights in the event of delay or cancellation lie with the airline under the applicable air passenger regulations.
9. Accommodation
Hotel star ratings are the classification given locally and may differ from UK standards. Hotel names shown are indicative; during periods of exceptionally high demand (such as Ramadan and Hajj) a hotel of an equivalent standard may be substituted. Distances to the Haram are approximate. Rooms are provided on the occupancy basis booked and hotel check-in and check-out times apply.
10. Transfers, Ziyarat and guides
Transfer and Ziyarat timings may vary with traffic, prayer times and local conditions. Guides are provided to assist your group; each traveller remains responsible for their own belongings, documents and conduct.
11. Special requests and accessibility
Please tell us about any special requests, medical conditions, reduced mobility or dietary needs at the time of booking so that we can advise whether the arrangements are suitable. We will pass requests to suppliers but cannot guarantee that they will be met.
12. Your conduct
All travellers must comply with the laws and customs of the Kingdom of Saudi Arabia and observe the etiquette of the holy sites. We may terminate the arrangements of any person whose behaviour is, in our reasonable opinion, disruptive, dangerous or unlawful, without refund or compensation.
13. Travel insurance
We strongly recommend that every traveller holds comprehensive travel insurance covering medical expenses (including pre-existing conditions), repatriation, cancellation, curtailment and personal belongings for the whole of the trip.
14. Package Travel Regulations and financial protection
Where the arrangements you book with us constitute a “package” under the Package Travel and Linked Travel Arrangements Regulations 2018, you benefit from the rights set out in those Regulations and we accept responsibility for the proper performance of the travel services included in your package. Details of the financial protection that applies to your booking, and who provides it, will be confirmed to you in writing before you book.
15. Our liability
We will not be liable for any failure that is attributable to you, to a third party unconnected with the provision of the services, or to unavoidable and extraordinary circumstances. Where we are liable, our liability for losses other than personal injury is limited to three times the price paid for the affected arrangements, and any liability is subject to the limits set by international conventions such as the Montreal Convention.
16. Complaints
If you have a problem during your trip, please tell our representative or the supplier immediately so that it can be resolved. If it cannot be resolved, write to us at info@babulharamtravels.co.uk within 28 days of your return, quoting your booking reference.
17. Data protection
Our use of your personal information is described in our Privacy Policy.
18. Law and jurisdiction
These conditions and any dispute arising from your booking are governed by the law of England and Wales and are subject to the exclusive jurisdiction of the courts of England and Wales (or of Scotland or Northern Ireland if you live there and wish to bring proceedings there).
